What is Proposition 65?
California's Proposition 65, formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide warnings to California consumers before knowingly exposing them to chemicals that are known to the State of California to cause cancer, birth defects, or other reproductive harm.
The list currently includes over 900 chemicals, many of which occur naturally in food, soil, water, and the environment. A Proposition 65 warning does not mean a product is unsafe or in violation of any federal product safety standard.
Why does tea require a warning?
Tea plants naturally absorb trace amounts of heavy metals - including lead - from the soil in which they grow. This occurs even in organically grown tea, because lead is present in soil as a result of both natural geological processes and decades of industrial activity worldwide.
California's Proposition 65 threshold for lead is 0.5 micrograms per day. This limit is set so conservatively that many everyday foods — including potatoes, lettuce, carrots, and wheat - would require a warning if sold in California under the same standard.
Which products does this apply to?
This notice applies to all Snarky Tea products shipped to California addresses, including teas, accessories, and teaware. We apply the warning broadly rather than on a product-by-product basis, consistent with standard practice in the tea industry.
